Terms of Service

These Terms of Service ("Terms") govern your access to and use of ScanServe ("Service"), a QR menu and restaurant ordering platform operated by The Mark ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into a contract to use ScanServe. You are responsible for keeping your login credentials secure and for all activity under your account.

2. Subscription & Free Trial

ScanServe is offered on a subscription basis. New restaurants may be eligible for a 7-day free trial. After the trial, continued use requires an active paid subscription. Subscription fees, features and billing cycles are shown on our pricing page and may be updated with prior notice.

3. Payments & Merchant of Record

Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle handles order processing, payments, invoicing, subscription billing, applicable taxes, chargebacks, refunds and related customer service inquiries. Payment and billing terms are governed by the Paddle Checkout Buyer Terms, which apply to your purchase in addition to these Terms.

4. Acceptable Use

  • Do not use ScanServe for any unlawful, fraudulent or harmful activity.
  • Do not upload content that is illegal, misleading, or infringes another party's rights.
  • Do not attempt to reverse engineer, disrupt or misuse the Service or its infrastructure.
  • You are responsible for the accuracy of menus, prices, taxes and any order-related information you publish.

5. Your Content

You retain ownership of the menu items, images, restaurant details and other content you upload. You grant us a limited licence to host, display and process this content solely to operate the Service for you and your customers.

6. Intellectual Property

ScanServe, including its software, design, branding, documentation and all related intellectual property, is owned by The Mark. We grant you a limited, non-exclusive, non-transferable right to use the Service under your active subscription. You may not copy, resell, redistribute, reverse engineer, or create derivative works of the Service.

7. Service Availability

We work hard to keep ScanServe available and reliable, but we do not guarantee uninterrupted access. Maintenance, upgrades, or events outside our control may temporarily affect the Service.

8. Suspension & Termination

We may suspend or terminate your access if you breach these Terms, misuse the Service, or fail to pay applicable fees. You may cancel your subscription at any time from your account settings; cancellation stops future renewals.

9. Limitation of Liability

To the maximum extent permitted by law, The Mark is not liable for indirect, incidental, or consequential damages, or for lost profits, revenues, data, or goodwill arising from your use of the Service. Our total liability for any claim is limited to the fees you paid for the Service in the three months preceding the claim.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
